1. JOB APPLICANTS

Intro  

This Privacy Notice provides you with information about personal data processed by BlueAlp in relation to people applying for a job. This includes prospective employees, trainees and contractors.  

People who have successfully applied for a position or have been hired as a trainee or contractor are subject to the Privacy Statement – Employees/Contractors (chapter 2).  

This privacy notice explains: what personal data is processed, for what purposes, how long we keep personal data, how to access and update your personal data, other options relating to your personal data and where to obtain further information.  

BlueAlp Production BV, a company registered in the Netherlands with registration number 82644845, located at Steenoven 11, 5626 DK Eindhoven, the Netherlands is responsible for processing your personal data on behalf of itself or the company within BlueAlp where you may become employed or under contract.  
Minors  

If you are under 18, please do not send us your personal data (e.g. name, address or email address). If you do want to contact BlueAlp in a way that requires you to send your personal data (such as for education), please ask your parent or guardian to do so on your behalf.
Categories of personal data  

During the recruitment process, we ask you to provide us with information that enables us to assess your suitability for certain positions.  

This includes personal contact details (such as name, postal or email address and telephone number), date of birth, government-issued data and documentation required under immigration laws (such as passport number and expiry date, nationality, social security/national insurance/equivalent identification number and work permit),  your application, contact details of your references whose consent you must have obtained, your qualifications and experience and results of interviews.

Sensitive personal data
For the purpose of recruitment, sensitive personal data, including health data, are processed if required and to the extent permitted or required by applicable laws to make adjustments to the recruitment process, to assess job suitability and fitness for work, and to provide workplace facilities to resolve health issues or to establish, exercise or defend claims.  

Moreover, in order to ensure equal employment opportunities, additional sensitive personal data may also be collected from job applicants, including their nationality, race and/or ethnic origin if local laws and regulations permit or require it.  

In case we process special or sensitive personal data based on local requirements, we will notify you in advance.
Obtaining your personal data  

In most cases, we get the data directly from you. We may process personal data about you provided to us by third parties. This could, for example, be a recruitment partner, such as a recruitment and selection agency or an employment agency.
Purpose of processing

We process your personal data primarily for the following purposes:  
– to identify and evaluate your qualifications for available positions;
– to verify the data you submitted and carrying out reference checks, pre-employment screening and conducting background checks (where applicable);
– for recruitment marketing;
– to prepare a job offer and employment contract where applicable;
– to assess your fitness to work and for the provision of facilities in the workplace for any accommodation;
– manage and operate IT, business planning, financial management, risk management,  communication systems;
– to protect BlueAlp’s and the applicant’s health, safety and (IT) security; or
– compliance with laws and regulations.  

We may also process your personal data for a secondary purpose to which it is closely related, such as:  
– storing, deleting or anonymising your personal data;
– audits, investigations, fraud prevention, dispute resolution or insurance purposes.    
Legal basis  

We process your personal data for the following justified reasons:
– to take steps at your request prior to entering into a contract;
– the legitimate interest for recruitment and management purposes;
– to enter into and manage a contract or employment relationship;
– the protection of BlueAlp’s assets and reputation and BlueAlp’s employees and contractors, unless such interests give way to the overriding interest of your fundamental rights and freedoms;
– to comply with our legal obligations (such as applicable labour and social security laws);
– protect your vital interest or that of another person, for example in case of a medical emergency;
– your express consent.

In case processing is based on your consent, you may withdraw your consent at any time, unless local applicable laws and regulations provide otherwise. The withdrawal of your consent does not affect the validity of the processing of data prior to the moment you withdrew your consent.
Sharing of your personal data  

Your personal data will be processed solely for the above purposes and will be shared only on a strict need-to-know basis with:  
– other companies within the BlueAlp group;
– and any person to whom BlueAlp proposes to transfer any of its rights and/or obligations;
– authorised representatives, service providers and/or subcontractors of BlueAlp, in particular third parties checking references and background information on behalf of BlueAlp;
– authorised public authorities, government agencies, regulatory authorities or tax authorities where necessary to comply with an obligation under laws or regulations with which BlueAlp is required to comply or where permitted by applicable local law.  

We do not share all your data, but only the data necessary for the third party.  
If you choose to interact with BlueAlp through social media on a BlueAlp-managed social media page – such as Twitter or LinkedIn, depending on your privacy settings on the relevant social media platform, your personal data (such as your name, your profile picture and the fact that you are interested in BlueAlp) will be visible to all visitors to your personal webpage and also to BlueAlp. You can delete any data you have shared on these sites at any time via the account of your relevant social media platform. BlueAlp does not track your activity on the various social media sites you use. If you send a message to BlueAlp via a messenger service on a social media platform, these messages will not be retained for more than one month after receipt. Please contact BlueAlp as per the section below if you wish to make a request in the context of a BlueAlp-managed social media page and where you cannot take action yourself.  
Transfer of your personal data outside the EU

We will not transfer your personal date outside the EU.  
Safety  

We have implemented technical and organisational measures (TOMs) to protect your personal data from unauthorised access and improper use and will adapt these measures, where necessary, as new technology becomes available for this purpose.
Retention period

We retain personal data of rejected applicants for at least six months, but no longer than two years after the recruitment process.  

Information may be kept longer if there is reason to do so under laws and regulations (the information is then deleted when it is no longer needed for the purpose of those laws and regulations).  

If your application is successful, personal data collected during the recruitment process will be retained in accordance with Privacy Statement – Employees/Contractors (chapter 2).  

Personal data you provide as an applicant is necessary to comply with laws and regulations and/or for entering into a contract with you (or in case you are a contractor, your employer/service provider). Failure to provide us with requested data may affect your selection for employment or internship.  
Your rights

Where provided under the applicable law, you have rights in relation to your personal data, such as:

– The right to access the personal data we have about you
– The right to know how we process your personal data
– The right to have your personal data corrected
– The right to have your personal data deleted
– The right to restrict processing of your personal data by us
– The right to request a transfer of your personal data
– The right to receive your personal data, which you have provided to BlueAlp, in a structured, digital form for transmission to another party, where technically feasible.

2. EMPLOYEES/CONTRACTORS

Intro  

This Privacy Notice provides you with information about personal data processed by BlueAlp in relation to people who are or were employees, trainees or individual contractors of BlueAlp (“BlueAlp Personnel”) and where relevant their family members.  

Job applicants are subject to the Privacy Statement – Job Applicants (chapter 1).  

This privacy notice explains: what personal data is processed, for what purposes, how long we keep personal data, how to access and update your personal data, other options relating to your personal data and where to obtain further information.

Categories of personal data

We process personal data necessary to manage the employment relationship and to employ contractors and trainees.  

This includes: address information, date of birth, marital status, payroll and bank account information (such as IBAN), salary and benefit information including beneficiary information, emergency contact person, performance information, IT and workspace related information (such as license plate registration, IP-address, mail address and access rights) and other information necessary to manage the employment relationship and to employ contractors.  

Sensitive personal data
We also process some special categories of personal data (such as data relating to an individual’s health (e.g. absenteeism, reintegration and maternity leave) and social security number), but only to the extent necessary to comply with labor or social security law, to the extent necessary to provide company medical advice or support, to protect an individual’s interests (such as in an emergency), to the extent necessary for public health reasons or if the individual has given explicit consent.
Obtaining your personal data
In most cases, we get the data directly from you. We may process personal data about you provided to us by third parties. This could, for example, be a recruitment partner, such as a recruitment and selection agency or an employment agency.
Purpose of processing  

We process your personal data primarily for the following purposes:  
– to perform the (employment) contract, including drafting an (employment) agreement, implementing employment conditions, applying company medical care, training and determining a severance payment;
– keeping correct and complete records of your personal data;
– determining the amount of net (travel) expense reimbursement;
– compliance with laws and regulations;
– providing access to BlueAlp’s buildings;
– facilitating and supporting employees, including in the field of IT;
– organizational analysis and development, including budgetary, financial and organizational planning;
– administration, compensation, performance management, and;
– health, safety and security.  

We may also process your personal data for a secondary purpose that is closely related, such as:  
– storing, deleting or anonymizing your personal data;
– theft, fraud prevention, audits, investigations, dispute resolution or insurance purposes, dispute resolution and claims defense;
– orstatistical, historical or scientific research.  

Monitoring
We monitor e-mail, telephone and internet use to identify unauthorised and improper use and to ensure the security of the BlueAlp environment.  

All BlueAlp Personnel receive an access badge that allows BlueAlp to record the date, time and access points used by individuals within BlueAlp’s facilities. Data from the access and security systems are used:  
– for health, safety and security purposes, in particular to protect BlueAlp’s assets, BlueAlp’s employees and visitors to BlueAlp;
– to comply with legal and regulatory requirements; and
– to monitor (on an aggregate basis) the number of persons entering or working at BlueAlp for Human Resources and property planning purposes.  

Employment screening
Everyone who starts working at or for BlueAlp is screened beforehand. We do this to assess the integrity of our employees. The screening in any case involves checking the lists of the various incident registers of financial institutions and the sanctions lists.  

Your integrity will also be tested during the performance of your duties at BlueAlp. Personal data collected through the screening process will not lead to automated decision-making regarding suitability for continued employment, internship or employment as a contractor.  
Legal basis  

We process your personal data for the following justified reasons:
– to comply with our legal obligations (such as applicable labour and social security laws);
– protect your vital interest or that of another person, for example in case of a medical emergency;
– to enter into and manage a contract or employment relationship;
– the protection of BlueAlp’s assets and reputation and BlueAlp’s employees and contractors, unless such interests give way to the overriding interest of your fundamental rights and freedoms; the legitimate interest of health, safety and security reasons to ensure that only authorized personnel can enter sites or company facilities;
– the legitimate interest for recruitment and management purposes;
– in special circumstances, your express consent.  

In case processing is based on your consent, you may withdraw your consent at any time, unless local applicable laws and regulations provide otherwise. The withdrawal of your consent does not affect the validity of the processing of data prior to the moment you withdrew your consent.  

The personal data we request from you is necessary for the aforementioned purposes. If you do not do not provide them, this may affect the hiring process and the further execution of the (employment) agreement.  
Sharing of your personal data  

Your personal data will only be processed for the above purposes and will only be shared on a strict need-to-know basis with:  
– other companies within the BlueAlp group;
– authorized representatives, service providers and/or subcontractors of BlueAlp;
– authorized public authorities, government agencies, regulatory authorities (such as UWV (body implementing employee insurance schemes in the Netherlands) and Arbo (occupational health)) or tax authorities if necessary to comply with an obligation under laws or regulations or if permitted by applicable law; and
– any person to whom BlueAlp intends to transfer any of its rights and/or duties.  

We do not share all your data, but only the data necessary for the third party.  
Transfer of your personal data outside the EU

Your data is mostly processed within the European Economic Area (EEA). If we share data with parties based in a country outside the EEA or where personal data is processed outside the EEA we will ensure that the protection of your personal data remains adequately guaranteed. We will then for example use the Standard Contractual Clauses. We make clear agreements with parties, so that processing takes place in accordance with European legislation.
Safety

We have implemented technical and organisational measures (TOMs) to protect your personal data from unauthorised access and improper use and will adapt these measures, where necessary, as new technology becomes available for this purpose.
Retention period

We will retain your personal data no longer than necessary for the purpose for which we collected your personal or to comply with laws and regulations. In some cases, the law determines how long we may or must keep data. In other cases, we ourselves have determined on the basis of laws and regulations how long we need your data. Most personal data of (former) employees and contractors are deleted no later than five years after the end of the employment or contract unless they are still needed at that time to comply with a legal obligation incumbent upon us. For example due to applicable tax laws, salary data are kept for a longer period, i.e. at least seven years.

This Privacy Notice provides you with information about personal data processed by BlueAlp with respect to (i) individuals who work for or on behalf of, or who are shareholders of, our customers (“Customers”), (ii) suppliers or vendors (“Suppliers”), (iii) business partners, including within joint ventures not operated by BlueAlp, as well as investors and shareholders (“Partners”)  

For individuals requiring access to a BlueAlp building on behalf of a Customer, Supplier or Partner, you will be asked to provide additional information so that you can be identified for health, safety and security purposes.

– Health, safety and security, including protection of an individual’s life or health, occupational health and safety, protection of BlueAlp businesses and personnel, authentication of individual status and access rights; or
– Compliance with laws and/or regulations.  

We may also process your personal data for a secondary purpose that is closely related, such as:  
– storing, deleting or anonymizing your personal data;
– theft, fraud prevention, audits, investigations, dispute resolution or insurance purposes, dispute resolution and claims defense; or
– statistical, historical or scientific research.

Screening
We may use your personal data for the purpose of screening to comply with laws and regulations related to sanctions, money laundering, bribery and corruption.

– preparations to entering into a contract;
– comply with laws or regulations;
– where necessary for the legitimate interests of BlueAlp, unless those interests must override the overriding interest of the fundamental rights and freedoms of the individuals concerned; or

In case processing is based on your consent, you may withdraw your consent at any time, unless local applicable laws and regulations provide otherwise. The withdrawal of your consent does not affect the validity of the processing of data prior to the moment you withdrew your consent.  

Failure to provide the required information affects our ability to maintain contact with you or (continue to) enter into contracts with you or other parties.

Retention period

Personal data necessary for concluding and executing agreements will be kept for the duration of the contractual relationship and up to 15 years thereafter. In all other cases, up to 15 years after being collected.
